This article draws on key models of monitoring and blockholding articulated in the incomplete contracts theory of the firm. Under incomplete contracts theory, different governance systems have incentive structures that entail different tradeoffs—tradeoffs between ownership concentration and liquidity, between monitoring and management initiative, and between private rent-seeking and activity benefiting shareholders as a group. The tradeoffs delimit opportunities for productive cross-reference. More specifically, blockholder systems, such as those in Europe, subsidize monitoring by permitting blockholders to reap private benefits of control (...) through self-dealing and insider trading. Market systems, such as those in the United States and Britain, regulate such private rent-seeking toward the end of maintaining an institutional framework that supports diffuse share ownership and liquid trading markets. It follows that a legal framework conducive to blockholding may be ill-equipped to foster dispersed equity ownership and thick trading markets and that a legal framework conducive to liquid trading markets may have properties that discourage blockholding. This gives rise to questions for law reform agendas on both sides of the Atlantic. In the United States, proponents ask for deregulation of controls on institutional investors, looking to encourage blockholding and more effective monitoring. In Europe, proponents ask for stronger securities regulation, looking to encourage deeper trading markets. This article suggests that each reform program may lead to disappointing results because neither assures conforming adjustments to the pertinent actors’ incentives. Alternatively, strict reforms that materially change prevailing incentive patterns could perversely destabilize workable arrangements without assuring the appearance of more effective alternatives. Solidarity is a complex theoretical and historical investigation of one of the most dynamic social movements in post-World War II Europe. For some time now, Touraine has attempted to develop a comprehensive theory of social movements. In Solidarity, he and fellow researchers François Dubet, Michel Wieviorka, and Jan Strezelecki, apply the theories of action, movement and sociological intervention elaborated in The Voice and The Eye to the situation in Poland 1980-1. Bracken synthesizes Polanyi’s notion of morphogentic field and Whitehead’s notion of societies of actual occasions. These comments emphasize the implications of the metaphors involved in these notions. The rnetaphor of plants growing in afield lies beyond the concept of a morphogenetic field, and the metaphor of a society of interacting persons lies behind the concept of a society of actual occasions. I suggest that one of the implications of this metaphor is that there is not, as Bracken argues, a problem (...) of continuity in Whitehead’s metaphysics of events. (shrink)

Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. During the Middle Ages, philosophers and theologians argued over the extramental reality of universal forms or essences. In the early modern period, the relation between subjectivity and objectivity, the individual self and knowledge of the outside world, was a rich subject of debate. Today, there is considerable argument about the relation between spontaneity and determinism within the evolutionary process, whether a principle of spontaneous self-organization as well as natural selection is at work in the aggregation of molecules into cells and (...) the development of primitive forms of life into complex organisms. In _Subjectivity, Objectivity and Intersubjectivity_, Joseph A. Bracken proposes that what is ultimately at stake here is the age-old problem of the relationship between the One and the Many, universality and particularity on different levels of existence and activity within nature. Bracken rejects traditional models of this relationship, wherein either the One or the Many is presupposed to have priority over the other. He instead suggests that a new social ontology—one that is grounded in a theory of universal intersubjectivity—protects both the concrete particularity of individual entities in their specific relations to one another and their enduring corporate reality as a stable community or environment within Nature. What emerges is a bold reimagining of the sometimes strained relationship between religion and science. Bracken's clear writing, sophisticated philosophical analysis, and exemplary scholarship will lend this new work an enthusiastic appreciation by readers with deep interests in philosophy and philosophical theology. Beyond Decolonial African Philosophy dives into decoloniality discourse, challenging some of its shortcomings and offering alternative perspectives on the nature of Africanity and Afrotopia (Africa's better future) from leading African philosophers. Beginning with an overview of philosophy in contemporary Africa, the first half of the book goes on to critically interrogate and rethink decoloniality's deconstructivist approach. The correct understanding of the concept of heart in Rahner consists in a recognition that the highest performance of a finite spirit comprises affective, cognitive, and volitional consciousness in a functional union that could be called the heart-mind. Rather than privilege cognition and volition and then consider feelings and moods as separate and purely subjective phenomena, we must recognize the intentionality of certain higher affective responses, i.e., those that have become integrated into the highest operational synthesis of a person who (...) is developing as an adult in matters ethical and mystical. When it comes to dealing with population growth, there are a number of misconceptions about the position of the Catholic Church. Official teaching during the twentieth century gradually moved toward the acceptance of limiting family size and endorsed the concept of responsible parenthood during the Second Vatican Council. One cannot, therefore, justifiably claim that the church is against birth control. It is an entirely different matter, however, when it comes to the practical question about how a couple might go about (...) regulating fertility. Since the publication of Pope Paul VI's 1968 encyclical, an intense controversy has taken place within the church about the use of artificial contraception. Behind that controversy lies an important methodological issue. For, the traditional teaching to which Paul VI returned in his letter was based upon the presumption that it is possible to morally judge a physical, material act without any consideration of the persons who performed that act, the circumstances within which it took place, or the reasons why the act was chosen. This behavioural approach to morality stands in some contrast to the way that other moral questions are dealt with. Inflicting pain or even taking a person's life, for instance, can be justified for a good reason when one acts in a virtuous manner to instil discipline or safeguard justice. Until this methodological controversy is addressed, the problem of using artificial means to regulate fertility will not be resolved. A helpful key for solving the methodological ambiguities is to use moral language in a consistent and understandable manner. (shrink)

The Papal Encyclical Veritatis Splendor (1993) proposes a model of moral theology based on the notion of universal and unchanging ethical principles that guide the Christian moral life. It also helps to clarify a number of questions about the moral teachings of the Post-Vatican II Church. But Veritatis Splendor has not been received without some serious criticisms. Among the various reservations about the encyclical are that it misrepresents the current state of the questions in contemporary moral theology, that it parodies (...) the positions of a number of responsible moral theologians, and that it offers a vision of moral-theological issues that does not correspond to the world with which most professional and pastoral workers are familiar. The contributors to this volume - all leading professional Roman Catholic theologians - clearly interpret various key statements made by Veritatis Splendor and assess the overall accuracy of the encyclical's moral vision. In the process these essays also demonstrate the true significance of this important Church document for Christians today. (shrink)

The Sulwan al-Muta' is an 800 year-old handbook for statesmen written by a Sicilian Arab who addressed this advice for a "just prince" based on Islamic morality, European realism and a broad-ranging knowledge of different cultures. The work is explicated using straight philosophical discourse as well as the narrative whirl of fables-within-fables so beloved of ancient and mediaeval Oriental literature. This is a work of practical political philosophy that combines penetrating contemporary analysis, the entertainment value of The Thousand and One (...) Nights , and the deep insight of Sun Tzu. Reconciliation is a theologically-charged word with politically-charged implications. The work of the South African Truth and Reconciliation Commission (TRC) raised questions about reconciliation in a political context including the “parts” or “partners” of reconciliation: truth-telling, repentance, amnesty, reparations, and ultimately forgiveness and justice. This paper explores two questions. First, are theologians ready to give up an exclusive claim on reconciliation as a theological term or, at the very least, be agreeable to the fact that reconciliation might have political as well (...) as theological meanings? Second, if reconciliation is granted unhindered access across the borders of theology and politics, what wisdom from the theological tradition has informed the political praxis of reconciliation, and has political praxis in any way challenged our theological understanding of reconciliation? As responses to these questions, the paper looks at the theological development of reconciliation, with particular attention to the New Testament and subsequent historical praxis. We investigate the causal effects of religious service attendance on prosocial behaviours using longitudinal data from a nationally representative sample of 33,198 New Zealanders collected between 2018 and 2021. Our study innovates in three ways: (1) we use longitudinal rather than cross-sectional data; (2) we incorporate measures of help received alongside self-reported giving; and (3) our statistical models are designed to address causal questions, rather than simply to describe change over time. We model causal contrasts for three hypothetical interventions – (...) increasing, decreasing, or maintaining religious service attendance – and assess their effects on eight distinct prosocial domains. Study 1 focuses on self-reported charitable donations and volunteering. Studies 2 and 3 examine receiving help – both personal and financial – from family, friends, and the wider community. Across all analyses, we find that the causal effects of religious service attendance are notably smaller than cross-sectional correlations suggest. However, even modest increases in regular attendance would result in charitable donations equivalent to approximately 4% of the New Zealand Government’s annual spending – a considerable public benefit. By applying robust methods for causal inference to national-scale panel data, our study provides insights that can inform public policy about the social functions of religious participation and advances a methodological framework for investigating the social consequences of cultural practices. This chapter argues that, sometimes, disabled bioethicists actually have a duty to do public philosophy. It contends that this duty can be justified with ethical, epistemic, and prudential reasons. Any triage protocol will discriminate against disabled people if one uses a broadly inclusive definition of disability that subsumes diseases or chronic illnesses that can be disabling in their effects, like cancer or kidney failure. The most obvious reasons justifying a duty to do public philosophy as a disabled bioethicist are ethical. (...) One example of this testimonial injustice vis à vis disability and well‐being occurred during the early days of the COVID‐19 pandemic when medical triage protocols were being developed to ration critical care resources. Discriminatory triage protocols also diminish a disabled person's autonomy. The COVID‐19 pandemic amplified these costs in many ways but also created an opportunity for philosophical reflection that demonstrates the importance of more public‐facing work. (shrink)

It is sometimes argued that medical professionals should protect a future child's rights by prohibiting disabled parents from using technology to deliberately have a disabled child because disability is taken as an inevitable, severe threat to a child's otherwise “open” future. I will first argue that the open future that allegedly protects a child's future autonomy is precluded by the very conditions needed to develop that future autonomy. Any child's future will be narrowed as they are socialized in a way (...) that gives them the capacity for autonomous choice. However, oppressive master narratives can diminish a future child's autonomy by distorting their narrative identity and constricting their agency. In fact, the open future argument does just this by advancing one of the most damaging master narratives about disability: that disability inevitably and severely restricts a person's autonomy and closes their future. As death, and its allies pain and suffering, have increasingly become subject to medical treatment and social control, we think of them in new ways. However, as important as this fundamental transformation is, I have chosen to discuss something entirely different in this essay: I contend here that death has a particular sting for us of the contemporary world since we lack stories (...) and metaphors to talk about it. The deeply entrenched, sometimes heated conflict between the disability movement and the profession of bioethics is well known and well documented. Critiques of prenatal diagnosis and selective abortion are probably the most salient and most sophisticated of disability studies scholars’ engagements with bioethics, but there are many other topics over which disability activists and scholars have encountered the field of bioethics in an adversarial way, including health care rationing, growth-attenuation interventions, assisted reproduction technology, and physician-assisted suicide. The tension between the (...) analyses of the disabilities studies scholars and mainstream bioethics is not merely a conflict between two insular political groups, however; it is, rather, also an encounter between those who have experienced disability and those who have not. This paper explores that idea. I maintain that it is a mistake to think of this conflict as arising just from a difference in ideology or political commitments because it represents a much deeper difference—one rooted in variations in how human beings perceive and reason about moral problems. These are what I will refer to as variations of moral psychology. The lived experiences of disability produce variations in moral psychology that are at the heart of the moral conflict between the disability movement and mainstream bioethics. I will illustrate this point by exploring how the disability movement and mainstream bioethics come into conflict when perceiving and analyzing the moral problem of physician-assisted suicide via the lens of the principle of respect for autonomy. To reconcile its contemporary and historical conflict with the disability movement, the field of bioethics must engage with and fully consider the two groups’ differences in moral perception and reasoning, not just the explicit moral and political arguments of the disability movement. The authors propose the integrity capacity construct with its four dimensions (process, judgment, development and system dimensions) as a framework for analyzing and resolving behavioral, moral and legal complexity in business ethics' issues at the individual and collective levels. In taking properties to have powerful or dispositional essences, dispositionalism is primed to provide an account of causation. This paper lays out a challenge confronting the dispositionalist’s ability to account for how powers causally interact with one another so as to bring about collective results. The challenge, here labeled the “interaction gap,” is raised for two competing kinds of approaches to dispositional interaction: contribution combinationist and mutual manifestationist. After carefully highlighting and testing potential resources for closing the interaction gap, it (...) is concluded that the mutual manifestationist approach holds a significant advantage. In turn, the importance of the interaction gap itself is highlighted. While powers prime an ontology to yield an account of causation, how far that account can actually go depends on the metaphysical details of one’s view of powers and their causal interaction. Heine is one of Germany's most renowned poets. His Jewish heritage and his Christian baptism have informed both his life's work as well as its reception. He was an expert and a passionate reader of the Bible. Despite his criticism of the official system of churches and religious communities, he greatly appreciated religion and its symbolic language, which speaks especially to the poet – even in its silences.

It may seem obvious that causing disability in another person is morally problematic in a way that removing or preventing a disability is not. This suggests that there is a moral asymmetry between causing disability and causing non-disability. This chapter investigates whether there are any differences between these two types of actions that might explain the existence of a general moral asymmetry. After setting aside the possibility that having a disability is almost always bad or harmful for a person (a (...) view that we have critiqued at length elsewhere), seven putative differences are considered. Ultimately, it is concluded that none of these seven factors can ground a general moral asymmetry between causing disability and causing non-disability, though each factor can provide some moral reason to avoid causing disability in certain particular cases. Some Whiteheadians argue that past actual entities only exist and are available for prehension by later actual entities within the divine consequent nature. Others insist that past actual entities are objectively immortal and available for prehension within the extensive continuum. Based on an interpretation of Whiteheadian societies as structured fields of activity for their constituent actual occasions, this article proposes that the world has an objective reality even apart from the existence of God, and that past actual entities arereflected in (...) the current structure of the cosmic process.
